Senate approves legislation strengthening property rights

The Senate approved Senate Bill 540 on Wednesday, strengthening the rights of property owners across the state, said Sen. John Pappageorge, R-Troy.
"The government's first priority is to preserve the rights and safety of its citizens," Pappageorge said. "This common sense legislation will help protect the private property rights of residents across Michigan."
Under the proposed legislation a person that enters or remains on fenced or posted farm property without consent of the owner would be guilty of a misdemeanor punishable by up to 30 days in jail and fines up to $250.
Current law requires the landowner to request that an individual leave his or her property before there could be a trespassing violation.
The bill includes an exemption for individuals who are in the process of attempting, by the most direct route, to seek consent from the landowner.
Senate Bill 540 will now go to the House of Representatives for consideration.
